Governance Reform: Release of Bail Report
CLPR has done a first-time extensive study to bail decision-making and released its report titled, “Re-Imagining Bail Decision Making: An analysis of Bail Practice in Karnataka & Recommendations for Reform” on March 30, 2020. This study looks at bail outcomes of accused at trial courts in three districts in Karnataka – Bengaluru, Dharwad and Tumakuru over a period of 6 months, to understand what guides the grant or non-grant of bail at the time of first production. It finds that bail outcomes depend on a variety of factors including the nature of offence, its classification as bailable or non-bailable, the punishment prescribed and effective legal representation by lawyers. Using the extensive findings,the report makes recommendations for statutory, judicial and institutional reform to improve bail decision making in India. Read more.
