On 23.07.2017, a gang of youths belonging to the MBC community attacked people from Scheduled Castes (SC) community and also damaged their properties at Puliyarambakkam Village, Cheyyar Taluk, Tiruvannamalai District. During the said incidence, Mr.Venkatesan, belonging to the SC community, was brutally attacked with a sharp knife. As a result of serious injuries, he died while on the way to the hospital. The Cheyyar Police has registered an FIR against the perpetrators of the atrocity by filing an FIR bearing Crime No.583/2017 dated 24.07.2017 for offences under Section 294(b), 147,148,323,324,302,363,506(ii) of IPC and 3(1) of Tamil Nadu Public Property (Prevention of Damage & Loss) Act,1992 and Section 3(1)(c), 3(1)(r), 3(1)(t) of the Prevention of Atrocities Amendment Act 2015.
When the younger brother of the deceased, Mr.Adhikesavan, applied before the District Collector of Tiruvannamalai seeking government job on compassionate ground, it was rejected by the District Collector’s office through an order dated 07.08.2018 on the mistaken ground that he had not applied for the job within three years. Therefore, on the basis of Rule 12(4) read with S. No. 46 in the Schedule in Annexure – I of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Rules, 1995 (As Amended in 2016), the younger brother of the deceased approached Madras High Court seeking a direction from the Hon’ble Court to quash the impugned order passed by the District Collector, Tiruvannamalai dated 07.08.2018 and direct the District Collector and the District Adi Dravidar Welfare Officer, Tiruvannamalai to provide the 3rd Petitioner with employment in a Government post on compassionate grounds within a stipulated time.
The District Collector of Tiruvannamalai on 07.07.2020 passed an order providing a government job to the younger brother as a “Junior Assistant” in the Anakavur Block Development Office on compassionate ground. He has also joined duty from 01.08.2020 at the said office.
It is to be noted that a Writ Petition is pending before the Hon’ble Madras High Court and the prayer with respect to the allotment of agricultural lands to the Mother and Father of the deceased person who lost his life during the incidence of atrocity is still to be fulfilled by the District Collector of the Tiruvannamalai.
