CLPR is excited to announce the 5th edition of ConQuest: India’s Premiere National Quiz on the Indian Constitution, History, and Politics

Over the last four years, ConQuest has become the largest quiz and educational activity celebrating India’s constitutional history and politics. Over 8000 students have engaged with the previous editions of ConQuest. ConQuest encourages undergraduate and graduate students from the natural sciences, engineering, social sciences, humanities, and law to engage with the Indian Constitution, law, politics, history and current affairs. Given the ongoing pandemic, there will be a few changes to this year’s edition of ConQuest.

It will be held completely online, allowing participants from all over the country to join us. Firstly, it will be held completely online, allowing participants from all over the country to join us. Secondly, we will not be conducting the Regional Finals; instead, we will conduct Knockout Rounds which will match the top 8 teams from each Regional Preliminary round against each other. We will begin with Regional Preliminary rounds conducted on our customized tech platform. The top eight teams from each Regional Preliminary will move on to the Knockout Rounds. The top two teams from each of the four Knockout Rounds will be in our Grand Finale, held in late October. Know more and Register here

Important Order of the Karnataka High Court on the implementation of the SC & ST Prevention of Atrocities Act 1989 in Karnataka

In an important order the Karnataka High Court passed directions to the State government for implementation of the SC and ST (Prevention of Atrocities) Act 1989 and its Rules. It questioned the state government for the delay in filing of charge sheets in cases under the SC / ST Act. The Court directed the Registrar General of the High Court to file a report on the status of the proposal to set up more of Exclusive Special Courts in Karnataka and also to consider providing special training workshops to judicial officers who are in charge of the special courts.

The Court also gave various other directions to the State Government to provide data regarding the regular holding of meetings of committees and regular training of the investigating officers appointed under the Act and to place on record compliance with regard to the provision of relief in cash or in-kind or both within 7 days to the victims of atrocities or their family members. The Court passed this order while hearing the petition filed by the Committee for Monitoring and Strengthening SCs/STs in Karnataka (CMASK), represented by Senior Counsel Jayna Kothari. SC Observer Recent Updates

Justice Arun Mishra retired last month in September. During his six-year stint at the Supreme Court, he emerged as one of the most popular judges in the current cohort and also as a judge often mired in controversies.

The SC Observer team analyzed his tenure at Supreme Court through various lenses and wrote two posts on it: the first post used a statistical approach to unpack his time at the court and the second highlighted some of the key judgments he authored and its significance.

Publications & Article

Jayna Kothari’s paper, “Trans Equality in India: Affirmation Of The Right To Self-Determination Of Gender” was published by NUJS Law Review. This paper discusses the evolution of the constitutional right to self-determination of gender identity in India under Article 21. It examines how the right to life also includes the right to bodily integrity which precludes the reliance of a medical model to decide gender identity and examines Indian and comparative jurisprudence on this issue. It argues for the need to abolish a medical model of gender identity recognition and a re-affirmation of the right to self-determination of gender identity and a rejection of the claim of misuse and fraud which has been used frequently in India without any empirical data.
