The Respondent, Jeevan Santosh Martis was working as a Conductor, with Karnataka State Road Transportation Corporation (KSRTC), when he suffered an accident, leaving him with 40% permanent locomotor disability. Following this, light work was assigned to him. However, he was later asked to do much more difficult work. When representations were made by him stating that he can only do light work, he was issued three charge sheets, on separate occasions, stating that he had committed dereliction of duty. He made representations to higher authorities, such as the Director of Human Resources, KSRTC stating that these charge sheets had been made only to harass him. Despite these representations, the Respondent was finally suspended from service vide order dated 20.1.2018.
In this regard, the Disability Commissioner sent a letter to KSRTC, requesting quashing of the suspension order. Finally, on 22.12.2018, the suspension order against the Respondent was revoked. However, he was transferred from Puttur Depot to Sulya Depot.
In light of all these facts, the Disability Commissioner ordered that:
- The Respondent should be provided light work which he can discharge, and transfer him to his place of convenience
- To treat the suspension period of the Respondent as on duty and to provide him all the monetary benefits
- To provide 6% of the Respondent’s basic pay as travel allowance to from the date of issuance of his Disability Certificate.
This Writ Petition has been filed by the Petitioner, KSRTC, seeking to quash the order dated 18.03.2019 of the Disability Commissioner.
