Professor Adam Feibelman will be talking on ‘The Promises and Perils of India’s New Personal Insolvency and Bankruptcy Law’ as part of CLPR’s Occasional Talks series.

Professor Feibelman’s presentation will explore the promises and perils of India’s new personal insolvency and bankruptcy law.  This new regime represents a dramatic change in the legal landscape for individuals and households, yet it has been largely overshadowed by the new insolvency regime for commercial debtors. At this early moment, there are reasons to believe the new personal insolvency and bankruptcy law will at least be a modest improvement over the previous regime.  It could meaningfully expand protections for a significant segment of individual debtors in India from the debilitating costs and harms of financial distress.  If so, it would contribute to the development of a healthy consumer financial system.

About the Speaker: Professor Feibelman is the Sumter Davis Marks Professor of Law and Associate Dean for Faculty Research at Tulane Law School. He is currently in India as a Fulbright-Nehru scholar, based at the National Law School of India University.  His research and teaching interests include bankruptcy law, banking law and regulation, contracts, international finance, and international monetary law.
