Commercial surrogacy, largely an unregulated grey area, has been allowed in India since 2002. The debates around surrogacy have resurfaced with the recent order of the Supreme Court of India banning foreign nationals from hiring surrogate mothers.
Sonali Bhattacharya in her talk will discuss the legal and ethical dilemmas that emerge around surrogacy in India and competing rights – the rights of surrogate mothers, the rights of children born through surrogacy and rights of surrogate parents. She will also discuss the attempts made by the government to pass legislation pertaining to surrogacy in India, especially the Draft Assisted Reproductive Technology Bill and highlight the flaws and shortcomings of the Bill.
About the Speaker: Sonali Kusum is presently pursuing her Ph.D. on surrogacy law from the National Law School of India University, Bangalore. She has been an Assistant Professor at the School of Law, Tata Institute of Social Sciences and has also worked on issues related to child rights at the Centre for Child & Law, NLSIU Bangalore. Her areas of interest include human rights with a focus on child and women’s rights.
