Indirect Discrimination After Nitisha: Where Do We Stand?

On 19th September, the Centre for Law and Policy Research will host a discussion titled “Indirect Discrimination after Nitisha: Where Do We Stand?” at its office in Bengaluru. The session will be led by Asst. Prof. Jai Brunner (NLS Bengaluru) and will engage with the promise and challenges of advancing the doctrine of indirect discrimination in India.

Through this discussion, participants will reflect on why the landmark Nitisha ruling of the Supreme Court — which recognised that even seemingly “neutral” policies can reinforce structural disadvantages — has struggled to gain traction, and what lies ahead for the development of this doctrine in Indian equality jurisprudence.
