CLPR on behalf of Kokknada Krishna Teja, a person with 90% disability due to Becker Muscular dystrophy, filed a petition against the inaction of the Telengana State Public Service Commission with regards to the inaccessible location of the exam center for persons with disability.
This petition was filed to ensure that the State Service Commission adheres to the principle of reasonable accommodation under Section 2(y) as mandated under the Rights of Persons with Disabilities Act 2016 and provide equal access for persons with disability with regards to employment opportunities. In this case, the preliminary examination was held in the district to which the petitioner belongs to, however, the main examination was scheduled to take place in Hyderabad, as per the notification dated 19th February 2024. The petitioner, residing in Bhadradri Kothagudem, would have to travel more than 300km to appear for the examination.
The petitioner filed several representations to the State Service Commission on this issue, but no response was received. Therefore, through this petition before the Court, it was submitted that allotment of exam center be provided for at the Petitioner’s district as the denial of which would amount to violation of fundamental rights guaranteed under Article 19(1)(g) of the Constitution of India. In noting down the concern of the petitioner and the ability of the State Service Commission to notify more examination centers as required under the aforementioned notification, the Court disposed the petition and asked the State Service Commission to consider the relief requested by the petitioner.
