The Supreme Court started hearings on the Aadhaar Act on 17th Jan 2018. On the first day of hearings Mr.Shyam Divan laid out broad arguments against the Aadhaar Programme and Aadhaar Act. He asserted that this was the first time that the Constitution had been hollowed out by making certain inalienable and natural rights dependent on the acquisition of an identification.

On Day 2 of the Aadhaar Act case Mr.Shyam Divan continued his arguments and emphasized the faulty data collection process that had resulted in a number of legitimate beneficiaries being turned away, the lack of data security, and finally pointed out that collecting digital information without any safeguards around its use could be construed as a violation of the Fundamental Right to Privacy as profiles of individuals could be constructed from their online transactions.
